The petitioner is an accused in S.T. Case No. 01/25, arising out of Maheshpur P.S. Case No. 125/2024. It has been alleged that the petitioner had enticed away the niece of the informant on the pretext of marriage. Submission has been advanced by the learned counsel for the petitioner that an allegation of rape has not been made in the First Information Report and in her statement which finds reflection in para 38 of the case diary also no such allegation has been levelled against the petitioner. It has been submitted that the petitioner is in custody since 16.09.2024 and there has been an unexplained delay of three days in instituting the First Information Report. Learned A.P.P. has opposed the prayer for bail of the petitioner. On consideration of the aforesaid facts, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge, Pakur in S.T.
