HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 35200 of 2026 Court No. - 66 HON'BLE ARUN KUMAR SINGH DESHWAL, J. 1. Heard Sri Saurabh Kesarwani, learned counsel for the applicant, Sri Bhupendra Pal Singh, learned A.G.A. for the State and perused the record. No one appeared on behalf of the first informant despite service of notice. 2. The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No. 82 of 2026, under Sections 70(2), 137(2) BNS and Section 5G/6 of P.O.C.S.O. Act, Police Station Barla, District Aligarh, during the pendency of the trial. 3. Contention of learned counsel for the applicant is that in the FIR allegation has been made that the applicant had enticed away the daughter of the first informant in the presence of the first informant; subsequently, the victim was recovered and she, in her statement, stated that the applicant along with the co-accused, after administering sedative, kidnapped her and thereafter forcibly tried to marry her and also committed rape. It is further submitted that there are serious contradictions regarding the version mentioned in the statements of the victim recorded under Sections 180 and 183 BNSS and the victim has refused to undergo medical examination. It is further submitted that the first informant in her supplementary statement stated that she could not reply to the question as to why she mentioned that the applicant had enticed away her daughter in her presence. This creates doubt over the entire prosecution story. It is further submitted that the victim and the applicant were in a relationship and the victim left her house on her own free will and thereafter she returned back and, after the knowledge of this fact, the applicant has been falsely implicated in the present case. It is lastly submitted that no obscene video, as mentioned in the statement of the victim recorded under Section 183 BNSS, has been recovered by the police. This further creates doubt over the entire prosecution story. Versus Counsel for Applicant(s) : Darshan Gupta, Pranjal Chaudhari, Saurabh Kesarwani Counsel for Opposite Party(s) : G.A.
