JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before the Court calling in question registration of a crime in crime No.47/2025 registered for offences punishable under Sections 498A, 307, 323, 506, 465 and 34 of the Indian Penal Code, 1860 ('the IPC' for short). 2. Heard Sri. Harish Shiralakoppa, learned counsel appearing for the petitioner and Sri. Vinay Mahadevaiah, learned High Court Government Pleader appearing for respondent No.1. - 3 - HC-KAR NC: 2026:KHC:10885 CRL.P No. 1596 of 2026 3. petitioner is accused No.1/husband. Respondent No.2 is the complainant, his wife. The two get married on 19.04.2017. The relationship between the two appears to have turned sour and on the relationship turning sour, it transpires that several proceedings are initiated against each other. One such proceeding is the subject crime that is now registered for afore-quoted offences. 4. The learned counsel appearing for the petitioner would strenuously contend that the allegation of attempt to murder under Section 307 of the IPC does not get attracted at all, as the wife was staying away from the matrimonial house and there cannot be an allegation of Sections 323 or 307 of the IPC, as the case would be. 5. The matter is still at the stage of investigation. The allegation is attempt to murder of the wife and Sections 498A and 323 of the IPC. With these offences being in place, a jurisdiction under Section 482 of the Cr.P.C. cannot be invoked by the petitioner unless the investigation is completed and final report is filed before the concerned Court. - 4 - HC-KAR NC: 2026:KHC:10885 CRL.P No. 1596 of 2026 6.
