During hearing, learned Addl. P.P. submits that a petition for custody trial is pending before the Court of learned Special Judge, Gomati Judicial District and the date is fixed on 29th January, 2026 in that case. Under that circumstance, learned senior counsel, Mr. Debalay Bhattacharya does not press the petition, but submits that necessary direction may be issued to the learned Special Judge, Gomati Judicial District to dispose of the custody trial petition at the earliest and liberty may be reserved to the petitioners so that in case of any grievance they may approach this Court. Considered these submissions. The bail application is disposed of being not pressed. Learned Special Judge is directed to take up the custody trial petition of the investigating officer for hearing on the next date so fixed and to dispose of the same accordingly as per law. Needless to say, if further grievance persists, the petitioner may approach the appropriate forum in this regard. Send back the LCRs along with a copy of this order to the Court of learned Special Judge, Gomati Judicial District by tomorrow itself.
