Surana, Legal Aid Counsel, who has submitted that the applicant/convicted under Section 5 of Limitation Act, 1963 has preferred an appeal before this Court, being aggrieved with the judgment and order dated 27.09.2018 passed in Session Case No. 44 of 2015 by the learned Session Judge, Ri-Bhoi District, Nongpoh. However, while preferring such appeal, a delay of 2640 days have occurred, the reason being that the appellant is an uneducated and illiterate person who is not aware of his right to file appeal, and also the fact that because of the alleged incident, the convict is also going through a traumatic experience for which he is suffering emotionally and otherwise. On the basis of these compounded factors, there have been a delay in the process of filing the related appeal. It is prayed that the delay in filing the same may be condoned, since there are good grounds for the appeal to succeed, further submits the learned Legal Aid Counsel. Mr. R. Gurung, learned GA has entered appearance on behalf of the State respondent, and has submitted that the State has no objection to the prayer made for condonation of the delay and the appeal to be heard on merits. 2026:MLHC:106-DB We have heard the learned counsel for the respective parties, though we are also concerned with the inordinate period of delay, nevertheless, for end of justice, we are inclined and persuaded by the reasons cited in this application. Accordingly, the prayer made herein is allowed. The delay in filing the appeal is hereby condoned. Registry is directed to register the appeal and list the same for admission on 25th February, 2026.
