Vashistha, Spl.P.P. 02/ 19.02.2026: Heard learned counsel for the petitioners and learned counsel for the State. 2. The petitioners are apprehending their arrest in connection with Kanke P.S. Case No. 128 of 2025, registered under sections 316(5), 318(4), 338, 336(3), 340(2) and 61 (2) of BNS, pending in the Court of learned J.M. Ranchi. 3. Learned counsel for the petitioners submits that the petitioners are employee of informant and false allegations are made against the petitioners of defalcation of money. He next submits that Jharkhand State Beverages Company Limited demanded amount and the informant was having intention not to deposit the said amount with the Jharkhand State Beverages Company Limited as such the petitioners have been falsely implicated in this case. He further submits that the petitioners have not siphoned the amount and system was that one person appointed by the informant used to collect the sale price and hand over the same to the informant or bank in the evening. He next submits that the petitioners have ( 2026:JHHC:4974 ) complied notice under section 35(3) of BNSS, 2023 and petitioners have got no criminal antecedent which is disclosed in para 14 of the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that allegations are there of not depositing the amount and siphoning the said amount. 5. Considering that the petitioners are employee of informant and it has been pointed out that amount has not been paid to the Jharkhand State Beverages Company Limited and the informant has intention not to deposit the said amount with the Jharkhand State Beverages Company Limited. Further it has been pointed out that system was that one person appointed by the informant used to collect the sale price and hand over the same to the informant or bank in the evening, petitioners have got no criminal antecedent which is disclosed in para 14 of the petition and in that view of the matter, petitioners are directed to surrender before the learned court within two weeks from today and the learned court shall release the petitioners on terms and conditions and sureties as learned court deems fit and proper. 6.
