JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 2 25-09-2025 Heard Mr. Dhurendra Kumar, learned counsel for the petitioner and Mr. B.N. Pandey, learned APP for the State. 2. The petitioner has prayed for bail in connection with Motihari Muffasil P.S. Case No. 277 of 2021 registered for the offence punishable under Sections 384, 387, 120(B) and 506 of the Indian Penal Code. 3. The case of the prosecution is that one Rahul has made call on the mobile of the petitioner demanding rangdari. The call was made twice. 4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. From perusal of the F.I.R. itself it is clear that one Rahul Patna High Court CR. MISC. No.69369 of 2025(2) dt.25-09-2025 2/2 Sahani is alleged to have made call to the informant with respect to rangdari. The name of this petitioner has surfaced during investigation on the basis of confessional statement of co- accused Rahul Sahani. It has also been submitted that no call has been made by this petitioner. There is nothing save and except the confessional statement of the co-accused against this petitioner. Petitioner is languishing in judicial custody since 03.05.2025. 5. Learned APP appearing for the State has vehemently opposed the application for bail and has submitted that petitioner is having criminal antecedent of five cases. 6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Motihari Mufassil P.S.
