HIGH COURT OF JUDICATURE AT ALLAHABAD CONTEMPT APPLICATION (CIVIL) No. - 5509 of 2025 Court No. - 37 HON'BLE DINESH PATHAK, J.
1. Instant contempt application has been filed owing to wilful disobedience of the interim injunction order dated 24.05.2024 passed by the Civil Judge (S.D.), Bareilly in Original Suit No.439 of 2024 (Smt. Rashmi Tiwari vs. Bank of Baroda & Others).
2. In my opinion, the applicant has an alternative remedy to move an appropriate application under Order 39 Rule 2-A of the C.P.C. before the trial court. Instant contempt application is not maintainable for disobedience of the interim injunction granted by the Civil Judge.
3. In view of the above, instant contempt application is dismissed on the ground of alternative remedy. October 9, 2025 VR Versus Counsel for Applicant(s) : Vishwa Pratap Singh Counsel for Opposite Party(s) :
