By means of the present writ petition, the petitioner has prayed for the following relief: "Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.3, 4 and 5 to not dispossess the petitioner from his bhumidhari land bearing Khasra No. 228 measuring total area 0.1260 hectare situated at Village Madarpur, Pargana Ahraura, Tehsil Chunar, District- Mirzapur." 3. The contention of the learned counsel for the petitioner is that the proceedings for correction of map under Section 30/38 of the U.P. Revenue Code, 2006, initiated at the instance of the petitioner on 26.09.2022, is pending in the Court of Tehsildar, Tehsil- Chunar, District- Mirzapur. Allegation of the petitioner made in the writ petition is that some constructions are taking place at the behest of the concerned Pradhan in the plot No. 228 which belongs to the petitioner. 4. Submission of the learned counsel for the petitioner is that the petitioner has drawn the attention of the learned Sub Divisional Officer (respondent no.3) against the said ongoing illegal construction but his application has yet not been taken into consideration. 5. Learned Standing Counsel has placed before the Court the instructions dated 05.05.2025 received by him from the office of the Sub Divisional Officer, Chunar, District- Mirzapur. The relevant extract of the said instructions is as under: "दफफ-3- यह ककि यफचची दफरफ उकल्लिखखित उपखजिलफखधिकिफरची चचुनफर किके समक्ष प्रस्तचुत किखथित प्रफथिरनफ पत्र कदनफनांकि 30.08.2024 किकी जिजॉच किरफयची गयची। उक्त प्रफथिरनफ पत्र कदनफनांकि 30.08.2024 किफयफरलय पनांखजिकिफ मम दजिर हहोनफ नहची पफयफ गयफ हहै। दफफ-4- यह ककि प्रशनगत प्रकिरण किके सम्बन्धि मम क्षकेत्रचीय रफजिस्व कनररक्षकि किकी अध्यक्षतफ मम रफजिस्व टचीम दफरफ यफचची किकी उपसस्थिकत मम प्रश्नगत दहोननों आरफजिचीयतनों किकी पहैमफइश किकी गयची। पहैमफइश किके ररपहोटर सके स्पष्ट हहआ। यफचची किकी आरफजिची सनांख्यफ 228 व आ०स० 241 दहोननों हची आरफखजियफतनों किफ नक्शफ खिततौनची मम अनांककित रकिबके सके छहोटफ बनफ हहै तथिफ आ०सनां० 241 रकिबफ 0.506 हके० नक्शके मम रकिबफ 0.449 हके० बनफ हहै। आरफजिची सनांख्यफ 241 मम कमकडिल स्किक ल, पनांचफयत भवन, मजॉडिल शजॉप व रफस्तफ लगभग 0.204 हके० पर पकवर सके हची कनकमरत हहै। रकिबफ 0.165 हके0 पर 12 व्यकक्तयनों दफरफ अवहैधि अकतक्रमण ककियफ गयफ हहै। खजिस पर उत्तर प्रदकेश रफजिस्व सनांकहतफ 2006 किकी धिफरफ 67 किके तहत न्यफयफलय तहसचीलदफर चचुनफर मचीरजिफपचुर मके वफद कवचफरफधिचीन हहै। आ०सनां० 241 मम वतरमफन समय मम लगभग 0.081 हके० भककम परतची पफयची गयची। आ०सनां० 228 रकिबफ 0.126 हके0 किकी पहैमफइश सके स्पष्ट हहआ ककि नक्शके मम लगभग 0.1082 हके० बनफ हहै। मतौकिके पर यफचची किफ लगभग 0.1048 हके० पर किब्जिफ पफयफ गयफ। आरफजिची सनांख्यफ 228 किफ नक्शफ दचुरूस्तची किफ वफद न्यफयफलय खजिलफखधिकिफरची मचीरजिफपचुर मके कवचफरफधिचीन हहै। वतरमफन मम आ०सनां० 241 पर ककिसची प्रकिफर किफ किहोई नवकनमफरण नहहीं ककियफ जिफ रहफ हहै। पकवर मम गफम प्रधिफन दफरफ मजॉडिल शजॉप (सरकिफरची गल्लिके किकी दचुकिफन) बनफयके जिफनके हकेतचु गफम सभफ किकी आरफजिची सनांख्यफ 241 मम यफचची किकी आरफजिची सनांख्यफ 228 सके सटके हहए भफग पर नहींव डिफलची गयची। खजिस पर यफचची दफरफ आपखत्त दजिर किरफतके हहए यह किहफ गयफ ककि उक्त स्थिल मम मकेरची आरफजिची सनांख्यफ 228 किफ अनांग हहै तथिफ अपनची आरफजिची सनांख्यफ किफ नक्शफ सनांशहोधिन हकेतचु उकल्लिखखित प्रफथिरनफ पत्र किफयफरलय तहसचीलदफर मम कदयफ गयफ। यफचची व गफम प्रधिफन किहो अवगत किरफयफ गयफ ककि वफद कनस्तफरण तकि यफचची किकी आरफजिची सनांख्यफ 228 सके लगके हहए आ०सनां० 241 शकेणची 5-3 (ड) मम ककिसची भची प्रकिफर किफ किहोई कनमफरण किफयर नहची ककियफ जिफयकेगफ। (सनांलग्नकि-1,2) दफफ-5- यह ककि गफम प्रधिफन किहो उक्त कववफकदत स्थिल पर वफद कनस्तफरण तकि ककिसची प्रकिफर किके नवकनमफरण न ककियके जिफनके हकेतचु कनदरकशत किर कदयफ गयफ हहै।" 6. Copy of the said instructions has already been provided to the learned counsel for the petitioner in the Court today. 7. Learned counsel for the petitioner after going through the aforesaid instructions has consented for disposal of the writ petition in terms of the statement made by the learned Standing Counsel on the basis of the above quoted instructions provided to him by the Sub Divisional Officer, Chunar, Mirzapur. 8. Without adverting on the merits of the case, with the consent of the learned counsel for the parties present before the Court, the present writ petition is disposed of in terms of the aforesaid instructions dated 05.05.2025 as quoted hereinabove.
