JUSTICE S. B. PD. SINGH ORAL ORDER 2 25-09-2025 Learned counsel for the petitioner is directed to remove the defect no. 55, pointed out by the office, during course of the day. 2. The instant application has been filed on behalf of the petitioner for grant of the following relief(s):- “i. Issuance of direction order or writ in the nature of writ of mandamus or any other appropriate writs/orders/directions for Patna High Court C.Misc. No.930 of 2025(2) dt.25-09-2025 2/3 seeking a direction to the Learned Court of Sub Judge, Masaurhi/concerned Judge to expedite hearing of Title Suit No. 13 of 2020 filed by petitioner and to conclude the same in fixed time frame, as the same is being delayed by the Respondents when the said matter is at the stage of Defendant's evidence. ii. Issuance of direction order or writ in the nature of writ of mandamus or any other appropriate writs/orders/directions for protecting the property of the Petitioner and restraining the Respondents from alienating the property of the Petitioner, during the pendency of the Title Suit No. 13 of 2020. iii. Any other/ reliefs that the petitioners may found to be entitled to in the facts and circumstances of the present case.” 3. The above Title Suit is of the year 2020 and plaitiff’s evidence has been closed on 21.01.2025 and case is coming for evidence of defendant. 4. Learned counsel for the petitioner submits that the learned Trial Court is giving adjournment after adjournment to the defendants without any specific direction to adduce evidence. 5. Keeping in view the aforesaid fact, learned Trial Court is directed to expedite the trial as early as possible Patna High Court C.Misc. No.930 of 2025(2) dt.25-09-2025 3/3 and grant adjournment to the defendant in view of provisions of CPC and latest pronouncement of Hon’ble Apex Court. 6.
