1.PUBLIC PROSECUTOR The Court made the following Order: This Criminal Petition under Sections 480 and 483 of the BNSS, has been filed by the petitioner herein/A6, seeking `regular bail in Crime No.25 of 2025 of Prohibition and Excise Station, Guntur-Il, registered for the offences punishable under Sections 8(c) read with 21 (C) and 20(B)(ii)(A) of the NDPS, Act. 2. Brief facts of the case are that, on 18.02.2025, on receipt of credible information, the Prohibition and Excise Inspector, along with his staff and mediators, rushed to Empty site located at Right side of Venkateswara Swamy Temple, Brundavan Gardens, and found the accused in possession of 10.67 grams of METH & 1 kg of Ganja. The contraband along with other material was seized under the cover of mediators report. •\__ \`/ I i
3. Heard. perused the record. 4. Learned counsel for the petitioner subml'ts that basing on the confessl'onal statement of A4 and A5, the petitioner herein/A6 is arrayed as accused Ion the present crime. Except the said confessional statement, no other materl-al has been collected to connect the petitioner in commission of offence. The PetI®tiOner has been in judicial custody from 18.02.2025. 5. On the other hand, learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner herein. 6. A perusal of the material on record goes to show that except the confessional statement of A4 and A5, no other material is collected showing the complicity of the petitI-Oner in the commI'SSiOn Of Offence. lt iS Submitted by the learned counsel for the petitioner that the petitioner has permanent abode and there I'S nO POSSibiII®ty Of his fleeing away from the Jurisdiction of the court. It is submitted by the learned Assistant Public Prosecutor no previous antecedents have been reported against the petitioner. 7. ln view of the facts and circumstances of the case, since the petitl'oner herein is arrayed as accused basing on the confessional statement of A4 and A5 and the petitioner has /.

been in judic-Ial Custody from 18.02.2025, this Court -ls inclined to grant bail to the petitioner herein/A6, on the following conditions. i. The petitioner herein/A6 shall be released On bail On his executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two (o2) sureties for a like Sum each tO the satisfaction of the learned Special Judicial First Class Magistrate for prohibition & Excise, Guntur. ii. on release, the petitioner shall appear before the station House Officer concerned, Once in a fortnight, till fil'lng of the charge sheet. iii.
