HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 21610 of 2025 Court No. - 42 HON'BLE J.J. MUNIR, J.
HON'BLE PRAMOD KUMAR SRIVASTAVA, J. This writ petition has been filed seeking to quash the first information report dated 26.08.2025 giving rise to Case Crime No. 424 of 2025 under Sections 8/21/29 N.D.P.S. Act, P.S. Shamli, District Shamli. Heard learned Counsel for the petitioner in support of the motion to admit this petition at length and Mr. Anil Kumar Mishra, learned AGA appearing on behalf of the State. The petitioner seeks quashing of the impugned FIR on the ground that only evidence appearing against him is accomplice testimony, and on that basis, he has been connected to the present crime. From the possession of the apprehended accused, 312 gms of Smack has been recovered. The petitioner may have a good case to defend at the trial or may prove his non-complicity during investigation or press the point that he now makes in support of his application for bail et cetera but, this is not a ground on which the impugned FIR in an offence under the N.D.P.S. Act can be quashed. We do not find any good ground to quash the impugned FIR. This writ petition is dismissed.
