N RANGA REDDY (SC MC RSEEMA SPSR NLR) The Court made the following: THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 23467 OF 2014 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…..to issue a Writ, Order or direction more particularly one in the nature of Writ of mandamus declaring the inaction of the respondents No.2 and 3 in not taking action against respondents No.4 and 5 in stopping erection of cell phone tower as well as make it operational on the site of 4th respondent in midst of residential locality in S.Sadlapalli Village of Hindupur Municipal limits Anantapur District inspite of petitioners representation, inspite of repeated representations as illegal, arbitrary and unconstitutional and consequently direct respondents 2 and 3 to take immediate action to stop construction as well as making operational cell tower on the site of 4th respondent in midst of residential locality in S Sadlapalli Village of Hindupur Municipal limits Anantapur District and pass such other orders....” 2. Learned counsel for the Respondent No.5 would submit that the construction of Cell Towner is completed long back. 3. While recording the said submission, this Writ Petition, is therefore, disposed of, leaving it open to the petitioners to pursue their remedies as per G.O.Ms.No.2, Information Technology, Electronics & Communications Department (Communications Wing) dated 26.05.2023 issued by the Government of Andhra Pradesh, if so, advised.
