JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 15-02-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in a case registered for the offence under Section 317(5) of Bhartiya Nyaya Sanhita, 2023 and Section 30(a) of Bihar Prohibition and Excise Act. 3. As per F.I.R., 483.84 liters of illicit foreign liquor has been recovered from the house of co-accused Shiv Shankar Rai, 3.06 litres of foreign liquor from the TVS Scooty and 1.62 liters of foreign liquor has been recovered from Hero Splendor Motorcycle and thus, there is total recovery of 488.52 liters of foreign liquor was recovered from the spot. 4. It is submitted on behalf of petitioner that recovery has been effected from the house of co-accused Shiv Shankar Patna High Court CR. MISC. No.2747 of 2025(2) dt.15-02-2025 2/2 Rai and two other vehicles, which were parked on spot. Petitioner has got no concern with the alleged recovery. Petitioner is neither owner nor driver of any of the vehicles. Petitioner has got no criminal antecedent of similar nature. 5. Learned A.P.P. for the State has opposed the bail petition. 6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No. II, Muzaffarpur in connection with Kanti P.S. Case No. 616 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. anay (Prabhat Kumar Singh, J) U T
