JUSTICE KHATIM REZA ORAL ORDER 2 31-01-2025 Heard the learned counsel for the petitioners and learned APP for the State. 2. This application has been filed for modifying the order 17.12.2024 passed by this Court in Criminal Miscellaneous No. 61059 of 2024 whereby the petitioners have been granted bail with certain terms and conditions. 3. With regard to condition no. 2 imposed by this Court vide order dated 17.12.2024 passed in Crl. Miscellaneous No. 61059 of 2024, learned counsel for the petitioners submits that except the father and the sister of the petitioners, all other family members are accused in the present case. Learned counsel for the petitioners Patna High Court CR. MISC. No.6245 of 2025(2) dt.31-01-2025 2/2 further submits that the father of the petitioner nos. 1 to 3 predeceased them. The father of petitioner no. 4 is petitioner no. 1. It is also submitted that the petitioners have no sister. 4. Condition no. 2 of order dated 17.12.2024 passed by this Court in Criminal Miscellaneous No. 61059 of 2024 reads as under:- 2. One of the bailors will be their own blood relation, preferably father, mother, brother, sister and or his wife.” 5. Considering the aforesaid facts and averments made in the modification application, the said condition no. 2 is modified to the extent that one of the bailors will be close relatives of the petitioners. 6. Accordingly, modification application is allowed. 7. Four weeks’ further time from today is also granted to the petitioners to surrender before the court below in terms of the order dated 17.12.2024 passed by this Court in Criminal Miscellaneous No. 61059 of 2024. 8. The order dated 17.12.2024 passed by this Court in Criminal Miscellaneous No. 61059 of 2024 stands modified to the aforesaid extent. premchand/- (Khatim Reza, J) U T
