The claim of petitioner for payment of salary of post of Principal while working as Officiating Principal was earlier rejected by an order dated 29.07.2024, however, unfortunately, the said order is not under challenge and a mandamus is sought for fresh consideration. The Court takes note the above referred error in pleadings, still, in the interest of justice, since there are judgments (Vinod Kumar Yadav Vs. State of U.P. and 4 others, 2024:AHC:185775 and Smt. Raj Kishori Kushwaha, 2024:AHC:81205) which have also annexed in this writ petition that if there is no other legal impediment, petitioner is entitled to salary of Principal while working as an Officiating Principal, therefore, this writ petition is disposed of with an observation/ direction that petitioner will be revisit the issue and will not reject his claim only on a ground that earlier claim was rejected, if there is no other legal impediment.
