The petitioner has filed the present writ petition under Article 226/227 of the Constitution of India with a prayer to issue a writ in the nature of Mandamus directing the official respondents to grant the statutory pay scale of Rs.5910-20200+ Grade Pay of Rs.2800, later on increased to Rs.10300-34800+ Grade Pay of Rs.3600/- vide letter dated 15.12.2011 to him as per the revised pay scales Rules of 2009 (Annexure P-5 and P-6) along with arrears and interest thereon. A further prayer has been made to direct the respondents to take into account the statutory pay scale as per revised pay scale rules of 2009 (Annexure P-5). Further prayer has also been made to issue a writ in the nature of Certiorari to quash the instructions dated 17.07.2020 and 29.10.2020 (Annexures P-3 and P-4). 2. Learned counsel for the petitioner contends that the case of the petitioner is squarely covered by the ratio of the law laid down by this Court in CWP-15896-2023 (O&M), titled as “Saurabh Sharma and others Vs. State of Punjab and Anr.” dated 13.09.2024. 3. Learned counsel further submits that the petitioner has already submitted a legal notice dated 06.09.2025 (Annexure P-9) to the respondents HEMLATA 2025.09.12 01:51 I attest to the accuracy and integrity of this document CWP-27064-2025 -2- and he shall be satisfied in case, appropriate directions are issued to the respondent No.1 to decide the legal notice dated 06.09.2025 (Annexure P-9) in a time bound manner. 4. Notice of motion. 5. On the asking of the Court, Mr. Surya Kumar, AAG, Punjab, who is present in the Court, accepts notice on behalf of the official respondents and has no serious objection to the prayer made by learned counsel for the petitioner, at this stage. 6. I have heard learned counsel for the parties and perused the record carefully. 7. At this stage, it would be appropriate to direct respondent No.1 to decide the legal notice dated 06.09.2025 (Annexure P-9) in view of the law laid down by this Court in CWP-15896-2023, titled as “Saurabh Sharma and others Vs. State of Punjab and Anr.” dated 13.09.2024 within a period of four months from the date of receipt of certified copy of this order. 8. Needless to observe that respondent No.1 shall pass a speaking and well reasoned order in the light of the above referred judgment as well as relevant rules/instructions and in case, it is found that the petitioner is entitled to the relief claimed in the writ petition, all consequential benefits may also be released to the petitioner within a period of two months, thereafter, along with interest. 9. The present petition is disposed of, accordingly.
