By way of the instant petition, the petitioner seeks quashing of complaint No.09/2017 dated 28.07.2014 (Annexure P-1), under Sections 323, 379, 447, 420, 467, 471, 546 & 120-B IPC filed before the Court of Ld. Sub Divisional Magistrate, Assandh, District Karnal and well as setting aside of judgment of conviction and order of sentence dated 08.05.2018 (Annexure P-2). 2. However, today, at the very outset, learned counsel for the petitioner submits that he may be permitted to withdraw the instant petition with liberty to raise all the pleas, as have been raised herein, before the Court of Sessions at Karnal where his appeal challenging his conviction is pending, including his plea to the effect that the complaint came to be RAMANDEEP SINGH 2025.09.26 13:02 I attest to the accuracy and integrity of this document CRM-M-50885-2025 (O&M) 2 lodged under some misunderstanding, which has now been resolved and the matter stands compromised with the complainant. 3. Since the petitioner has already challenged the impugned judgment dated 08.05.2018 (Annexure P-2) by way of filing an appeal, which is stated to be pending before the Court of Sessions at Karnal, the instant petition is disposed of having been withdrawn with liberty to the petitioner to raise all pleas as have been raised herein, before the Appellate Court concerned. 4. It is further directed that the appeal filed by the petitioner before the learned Sessions Court at Karnal i.e. CRA-340-2018 titled as Sonu Kumar Vs. Kashmiri Lal shall be decided along with other appeals arising out of same very judgment be it any appeal against conviction or any appeal against acquittal. 5. Pending miscellaneous application(s), if any, also stands disposed of.
