The instant writ petition has been filed by the petitoners with the following prayer:- “(a) By an appropriate writ, order and direction in the nature thereof thereby the respondents may kindly be directed to allot disputed plot No.G-1051, Industrial Area, Bhiwadi to the petitioner instead of to any other entity. By way of filing this writ petition, the petitioners are seeking directions for allotment of Plot No.G-1051 at Industrial Area, Bhiwadi. 3. Learned counsel for the respondents submits that the petitioners have made encroachment upon the aforesaid plot for which notice was given to the petitioner on 23.08.2016 for removal of the same. Learned counsel submits that the aforesaid land cannot be allotted to the petitioners being contrary to the RIICO Disposal of Land Rules, 1979, hence, this writ petition is liable to be rejected. 4. Learned counsel for the petitioners submits that the petitioners are in possession of the land in question since time immemorial and after getting the aforesaid notice on 23.08.2016, the petitioners approached the Chairman-cum-Managing Director, RIICO for redressal of their grievances by way of filing representation, but instead of passing considerable time till date the said representation has not been decided on its merits by passing a reasoned and speaking order. 5. This Court is not going into the controversy involved in this matter as to whether the petitioners are entitled to get the possession/allotment of the plot in question or not and whether the petitioners have encroached the said plot or not, but looking to the fact that the representation submitted by the petitioners is still pending for adjudication at the level of Chairman-cum- Managing Director, RIICO, the instant writ petition stands disposed (3 of 3) [CW-4506/2023] of with a direction to the Chairman-cum-Managing Director, RIICO to decide the said representation (pending, if any) expeditiously as early as possible preferable within a period of three months, from the date of receipt of certified copy of this order by way of passing a reasoned and speaking order. 6. Stay application as well as all applications (pending, if any) also stand disposed of. (ANOOP KUMAR DHAND),J Karan/44
