The instant writ petition has been filed for following relief: "अ- आदेश/िनदेर्श िनगर्त करते हुए / प्रस्तुत यािचका स्वीकार करते हुए िवशेष न्यायाधीश (भ्र०िन०) कक्ष संख्या-4, वाराणसी के समक्ष लिम्बत तजबीजसानी प्राथर्ना पत्र / प्रकीणर् वाद संख्या 66/2020 (परमानन्द बनाम सुरेन्द्र) अन्र्तगत आदेश 41 िनयम 19 सी.पी.सी. एवं धारा 151 सी.पी.सी. अन्तगर्त िसिवल अपील नं0 449 सन 1981 के मुकदमें को िनरस्त िकया जाय।" 3. Contention of the learned counsel for the petitioner is that the aforementioned application under Order 41 Rule 19 is pending for adjudication, to which objections have been filed dated 13.09.2024. He prayed that the same may be decided expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. The present petition stands disposed of finally with a direction to the िवशेष न्यायाधीश (भ्र०िन०) कक्ष संख्या-4, वाराणसी to consider and decide the aforementioned application of the petitioner, in accordance with law, expeditiously, preferably within a period of Versus Counsel for Petitioner(s) : Niren Kumar Upadhyay, Yogesh Mishra Counsel for Respondent(s) : Sudha .....Petitioner(s) Parmanand Balig And 39 Others .....Respondent(s) 12 weeks from the date of production of a certified copy of this order after ensuring service upon all the respondents, after giving opportunity of hearing to the parties concerned provided that there is no other legal impediment.
