Mr. Yogesh Kumar Pacholia and Mrs. Meena Bisht, Advocates for the applicant. Mr. B.N. Molakhi, Deputy Advocate General for the State of Uttarahand. 2. This first bail application has been moved by the applicant seeking regular bail in F.I.R. No.0493 of 2024, under Section 109, 352, 118(1), 192(2), 191(3) and 61 of BNS, registered at Police Station Bahadarabad, District Haridwar. 3. It is contended by learned counsel for the applicant that applicant has falsely been implicated in the instant crime; has no criminal history and is languishing in jail since 23.06.2025. Learned counsel for the applicant submits that applicant was not seen in the CCTV footage, which is the sole basis on which the applicant has been implicated in the instant crime; that the injuries sustained by the injured are simple in nature, which is surgical stitched wound 1.5 cm x 1 cm situate on L Axilliary line. He submits that applicant is the only bread earner in the family and, due to his detention, his entire family is at the verge of starvation. He submits that in case, the applicant is granted bail, he will not misuse the same and will furnish the bail surety as per the satisfaction of this Court. 4. Learned State Counsel was directed to get instructions in the matter. Today, 2025:UHC:7674 on instructions, learned State Counsel submits that applicant is not visible in all the three video clips provided by the Investigating Officer. 5. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage. 6. The bail application is allowed. 7. Let the applicant, namely, Israr be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
