The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Complaint Case No. 38 of 2025, as well as cognizance/ summoning order dated 08.07.2025 by which the learned Magistrate took cognizance under Sections 115(2), 309(4), 309(6), 351(1) of B.N.S. (under Sections 323, 392, 394, 503 of I.P.C.), Police Station- Kamalganj, District Farrukhabad, pending in the court of Special Judge (D.A.A.)/ Additional Sessions Judge, Court No. 8, Farrukhabad. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ bail application/ anticipatory bail application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
