Neutral Citation No. - 2025:AHC:40223-DB Court No. - 29 Case :- WRIT - C No. - 31972 of 2024 Petitioner :- M/S Vikram Traders And Another Respondent :- State Of Up And 3 Others Counsel for Petitioner :- Sarveshwar Singh Counsel for Respondent :- C.S.C.,Shivendra Singh Bhadauria Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Pursuant to the orders passed on previous occasion, the Court is informed that necessary budgetary allocation has been made and substantial payment has already been released to the petitioner. It is also stated that the balance amount shall be released in a couple of days. In that view of the matter, we find that petitioner's grievance, as raised in this petition, is redressed. Learned counsel for the petitioner states that amounts found due, had become payable in the year 2019 and 2020 etc, therefore appropriate interest ought to be paid to the petitioner on such delayed release of amount. Once, the entitlement of the petitioner was undisputed, we find substance in the petitioner's submission that withholding of such admitted dues for so long, was not justified. In the facts of the case, we direct the respondents to calculate and pay interest at the bank rate for the delayed release of the amount. The District Basic Education Officer, Rampur shall calculate the amount of interest payable to the petitioner and communicate the same to the State within two weeks, from today. The State Government shall ensure release of the interest amount within a further period of two months. If the interest amount is not paid within a period of three months, as directed above, the petitioner shall be entitled to additional interest at the rate of 3 percent, which would be open to be recovered from the salary of the officer found responsible for non-compliance of this direction. The petition is, accordingly, disposed of. Order Date :- 20.3.2025 Noman Digitally signed by :- NOMAN AHMAD High Court of Judicature at Allahabad
