Government Advocate(Crl.Side) ORDER The Petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(2), 351(3) and 108 of BNS, 2023, in Crime No.603 of 2025 on the file of the respondent police, seeks anticipatory bail. 1/4 https://www.mhc.tn.gov.in/judis
2. The case of prosecution is that on 02.09.2025, the defacto complainant raised goats and 3 goats were missing from 01.09.2025. When the defacto complainant went to her sister Poongodi's house, at that time, her sister's daughter-in-law Abirami came and informed that 3 goats were tied outside the petitioner's house. On 02.09.2025, the defacto complainant along with her sister Poongodi went to the petitioner's house, she recognized her goat and the same was questioned by the petitioner. But the petitioner was abused with filthy language and pushed her sister and threatened with dire consequences. Again, the petitioner's brother Ramesh came to her house and scolded her sister Poongodi and thereafter, the defacto complainant and her relatives were compromising her sister. But she had committed suicide by hanging. Hence the complaint.
3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.
4. The learned Government Advocate (Crl.Side) submitted that there is tamper in evidence. Hence, he vehemently opposed to grant anticipatory bail to the petitioner. 2/4 https://www.mhc.tn.gov.in/judis
5. Considering the facts and circumstances of this case, there is tamper in evidence, this Court is not inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 12.09.2025
