Mr. B.D. Pande, Advocate for the petitioner. Mr. R.S. Bisht, Additional C.S.C. for the State. Mr. S.S. Lingwal, Advocate for the respondent no. 1, through video conferencing. Heard. The petitioner claims that she is entitled to family pension post death of her father with effect from 01.07.2022. Learned counsel for the petitioner submits that the petitioner is divorcee; her father was a government servant, and he was receiving pension, but he passed away on 01.07.2022. Thereafter, the petitioner is entitled to get the pension, but she has been denied for it; the petitioner has made a representation to the respondent no.1/Govind Ballabh Pant University (“the University”) of Agriculture and Technology, but a response is received from them that the matter has been referred to the respondent no.2/Director, Treasury, Pension and Hakdari, but no decision has been taken on it. Learned State Counsel submits that the respondent no.2/Director, Treasury, Pension and Hakdari, will take decision on the communication dated 24.07.2025, which is Annexure No.5 to the writ petition, of the University within a period of four weeks from today. The Court takes on record the statement given by learned State Counsel. The writ petition is disposed of with the direction to the respondent no.2/Director, Treasury, Pension and Hakdari, to decide the communication dated 24.07.2025, , which is Annexure No.5 to the writ petition, within a period of four weeks from today, in accordance with law with a reasoned and speaking order. In case the respondent no.2/Director, Treasury, Pension and Hakdari, considers that in order to pass any order, some documents are required from the petitioner, it shall be so conveyed to the petitioner in advance before taking any decision.
