At the very outset, learned counsel for the applicants seeks to withdraw the present application wherein the challenge has been raised in complaint case no. 1042 of 2023 (Ankita Yadav Chandrabali Yadav) pending in the court of learned Civil Judge Junior Division/F.T.C. (Crime against Women) Mirzapur, Under Section 498-A, 323 I.P.C. and 3/4 D.P. Act Police station- Chilh, District Mirzapur as well as summoning order dated 31.5.2025 passed by the learned Civil Judge Junior Division/F.T.C. (Crime against Women) Mirzapur, on account of incurable technical defects with liberty to file afresh. 2. Learned AGA has no objection to the same. 3. The application is dismissed as withdrawn with liberty aforesaid. 4. Certified copy be returned subject to submission of photocopy. 5. In case fresh application is being preferred, copy of the application be served to Sri Anil Kumar, learned counsel for the opposite party no.2.
