S. No. 04 Suppl Cause List IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR Bail App/259/2025 UMER FAROOQ AND ANR …Appellant/Petitioner(s) Through: Mr. Shuja Ul Haq, Advocate Vs. UNION TERRITORY OF J AND K TH.S.H. O P/S ANG KMR ...Respondent(s) Through: None CORAM: HON’BLE MR JUSTICE SANJAY PARIHAR, JUDGE O R D E R 03.06.2026 1. The petitioners were granted ad interim anticipatory bail by this Court vide order dated 22.12.2025 in connection with FIR No. 23/2025 registered for offences punishable under Sections 420, 467, 468 and 471 of the IPC after their application for anticipatory bail having earlier been rejected by the learned Sessions Judge, Anantnag, vide order dated 17.12.2025. 2. While granting the aforesaid interim protection, the petitioners were directed to join the investigation on 26.12.2025 at 11:00 A.M. and thereafter to cooperate with the investigating agency and remain available as and when required. The respondents were afforded repeated opportunities to file their response to the petition; however, despite the matter having been listed on several occasions, neither have any objections been filed nor has any attempt been made to contest the present proceedings. The conduct of the respondents clearly reflects a lack of interest in opposing the relief sought by the petitioners. Had the respondents been diligent in contesting the matter, they would have filed their objections and sought an expeditious consideration of the application. 3. In the absence of any opposition from the respondents and there being nothing on record to indicate that, subsequent to the grant of ad interim bail, the petitioners have violated any of the conditions imposed by this Court or have, in any manner, impeded the course of investigation, no justification is found for depriving them of the concession of anticipatory bail. 4. This Court had, while granting interim protection, recorded its prima facie satisfaction regarding the entitlement of the petitioners to such relief. The said protection has continued from time to time and, having regard to the conduct of the respondents in not contesting the matter, no useful purpose would be served by keeping the petition pending any further. The interests of justice, therefore, warrant that the interim order dated 22.12.2025 be made absolute. 5. Consequently, the present application is allowed and the ad-interim anticipatory bail granted to the petitioners vide order dated 22.12.2025 is made absolute, subject to the conditions stipulated therein. It is further directed that the petitioners shall continue to cooperate with the investigation, shall remain available before the Investigating Officer as and when called upon to do so, and shall appear before the Trial Court in the event a final report/charge-sheet is presented against them. 6. Disposed of as such. (SANJAY PARIHAR) JUDGE SRINAGAR 03.06.2026 Shabroz
