This Criminal Appeal is directed against the order dated 6.8.2024 passed by learned Special Judge, SC/ST Act, District Saharanur in Criminal Misc Case no. 523 of 2024 (Kiranpal Vs Nafeesh and others) under Sections 156(3) Cr.P.C. P.S. Sadar Bazar, District Saharanpur, whereby the application u/s 156(3) Cr.P.C. was treated as complaint. Heard learned counsel for the appellant and learned A.G.A. and perused the record. The main brunt of the arguments of the learned counsel for the applicant/applicants is that the applicant/applicants moved an application under Section 156 (3) Cr.P.C. in the trial court. The learned Judge, however, in a cursory manner ordered to register the application as a complaint case. Learned A.G.A. opposed aforesaid prayer and submitted that there is no illegality in the impugned order. On careful perusal of the impugned order and after considering the submissions made on behalf of the learned counsel for appellant, this court is of the view that the order passed by the learned Special Judge does not suffer from any illegality or infirmity and nor any abuse of the process of Court leading to the injustice is brought to the notice. Therefore, the present Criminal Appeal is devoid of merits and deserves to be dismissed at the threshold. The Criminal Appeal is dismissed accordingly.
