2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 115(2), 126(2), 35(2), 351(3), 191(2), 191(3), 190, 303(2), and 118(1) of the B.N.S.
2023.
3. As per the F.I.R., the specific allegation of assault has been made against co-accused Krishna Choudhary, who is alleged to have attacked the informant multiple times with hasua.
4. Learned counsel for the petitioners submits that,
Patna High Court CR. MISC. No.60972 of 2025(2) dt.09-09-2025 2/2 insofar as these petitioners are concerned, the allegations levelled against them are general and omnibus in nature. It is further submitted that there exists case and counter-case between the parties. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the fact that there is specific accusation of assault against the co-accused, namely, Krishna Choudhary, clean antecedent of these present petitioners and other circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Jagdishpur P.S. Case No. 75 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
