2 Bhartiya Nagarik Sanhita, 2023 has been filed by the applicants, who are apprehending their arrest in connection with Crime No.76/2025 registered at Police Station – Gandhinagar, District- Sarguja, (C.G.) for the offence punishable under Sections 406, 420, 467, 468, 471 and 120-B of the Indian Penal Code. 2. Case of the prosecution, in brief, is that the complainant lodged a report in the concerned Police Station to the effect that he gave his Hydra Mobile Crane bearing registration No.CG-12/U-0556 to applicant Toshram Malakar in the month of January 2022 on a monthly rent of Rs.15,000/-. Thereafter, the subject vehicle was sold to applicant Sitaram Chouhan by playing fraud. Hence, the aforesaid offence was registered. 3. Learned counsel appearing for the applicants submit that the applicants are innocent and have been falsely implicated in the present case. He further submits that in the affidavit so executed, it has been clearly mentioned that the complainant has sold the said vehicle to Sitaram Chouhan. He submits that the FIR has been lodged belatedly. Therefore, learned counsel for the applicants prays for grant of anticipatory bail. 4. On the other hand, learned State counsel, opposes the bail application. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case
3 and also considering the nature of allegations levelled against the applicants, this Court is not inclined to grant anticipatory bail to the applicants. 7.
Accordingly, this bail application of applicants – Toshram Malakar and Sitaram Chouhan involved in Crime No.76/2025 registered at Police Station – Gandhinagar, District- Sarguja, (C.G.) for the offence punishable under Sections 406, 420, 467, 468, 471 and 120-B of the Indian Penal Code, is rejected.
