Petitioner has challenged an order passed by Executing Court in Regular Miscellaneous Case No. 60 of 2025 (execution case no. 09 of 2025). By the said order, notice on petitioner’s application was issued to the decree holder. 3. Learned counsel for the petitioner submits that petitioner was not party to the suit, therefore, decree passed in the said suit would not bind him. 4. Learned Executing Court will consider the said aspect. Presently, this Court is not inclined to interfere in the matter. The Executing Court did the right thing by inviting objections from the decree holder. 5. The writ petition, however, is disposed of with a request to the Executing Court to make endeavour to consider the application filed by petitioner, within two months from the date of production of certified copy of this order.
