This writ petition has been filed with the following prayer:- "a) issue a writ, order or direction in the nature of MANDAMUS directing the court of Additional Commissioner (Judicial) Gorakhpur Division, Gorakhpur/respondent no. 2 to decide the Case No. 774 of 2022 computerized Case No. C-202205000000774/C-202505000002201 (Girish Upadhyay Versus Sadhu Sharan and others) under Section 331 (3) of U.P.Z.A. & L.R. Act pending before him expeditiously, or within the period fixed by this Hon'ble Court for the same, so that justice may be done." 2. It is contended by learned counsel for the petitioner that a recall application is pending in appeal filed under Section 331(3) of U.P. Z.A. and L.R. Act which has been dismissed for want of prosecution. The sole prayer made in the writ petition is for expeditious disposal of the recall application. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon respondent no. 2 to decide the recall application filed in Case No. 774 of 2022, Computerized Case No. C-202205000000774/C-202505000002201 (Girish Upadhyay Versus Sadhu Sharan and others), in accordance with law, after hearing all affected parties, preferably within a period of one month from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
