JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 09-09-2025 Heard learned counsel for the petitioners and the State . 2. Petitioners apprehend his arrest in a case registered for the offence punishable under sections 191 ( 2 ), 190, 126 ( 2 ), 115 ( 2 ), 352, 110, 118 (1) , 74 and 303 ( 2 ) of BNS. 3 . As per the prosecution case , informant namely , Bahadur Tanti alleged that on 19.03.2025 , all the F.I.R. named accused persons including these petitioners intercepted Patna High Court CR. MISC. No.61723 of 2025(2) dt.09-09-2025 2/3 informant and started abusing and assaulting him. When family members of informant came to save him, then they were also assaulted by accused persons. It is further alleged that accused persons also snatched gold chain of sister-in -law of informant. 4. It is submitted on behalf of the petitioners that dispute over pathway led to maarpeet in which both sides sustained injury. Allegation of assault is general and omnibus against these petitioners. Case and counter case . Case lodged by petitioners side is earlier in point of time . Rest of the allegations are ornamental in nature to make the case grave in nature . Petitioners claim clean antecedent. 5 . Learned counsel for the State opposed the bail petition . 6 Considering the general and omnibus allegation of assault against these petitioners, case and counter case , clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let these petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM Jamui in connection with Khaira P.S. Case No. 92 of 2025 , subject to the conditions laid down under section Patna High Court CR. MISC. No.61723 of 2025(2) dt.09-09-2025 3/3 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
