2. The petitioner seeks regular bail in connection with Shikarpur P.S. Case No. 778 of 2024 registered for the offence under Sections 137(2), 140(3) of the BNS, 2023, under Sections 3(i)(r)(s) of the SC/ST Act and Section 8 of the POCSO Act.
3. As per the prosecution case, the petitioner is accused of kidnapping the victim girl.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. He further submits that the petitioner has falsely been implicated in
Patna High Court CR. MISC. No.5485 of 2025(3) dt.19-04-2025 2/2 this case and is in custody since 02.11.2024.
5. Learned counsel for the informant has vehemently opposed the prayer for bail.
6. From the statement of the victim girl recorded under Section 183 of the BNSS, it appears that she had left her home on her own.
7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-7th-cum-Special Judge, POCSO, Bettiah, West Champaran/concerned Court below in connection with Shikarpur P.S. Case No. 778 of 2024.
9. This application for regular bail stands allowed.
