Also heard Mr. P. S. Lahkar, learned Additional Public Prosecutor for the State respondent. This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 praying for grant of pre-arrest bail to the accused/petitioner, who is apprehending arrest in connection with Bongaigaon P. S. Case No. 37/2025, registered under Section 325 of BNS read with Section 13(1) of the Assam Cattle Preservation Act. The case was listed today for production of the updated Case Diary before this Court, however, Mr. Lahkar, learned Additional Public Prosecutor has submitted that the I.O. has already filed Charge-Sheet in this case, vide Charge- Sheet No. 76/2025, dated 17.04.2025. He accordingly submits that the petitioner may be directed to appear before the learned Trial Court for regular bail. In this regard, Mr. Hussain, learned counsel for the petitioner, has submitted that he want to move an application for regular bail before the learned Trial Court and that the petitioner will appear before the learned Court below and will participate in the trial. Considering the submissions of learned counsels for both sides and also considering the fact that the case has already been Charge-Sheet, vide Charge- Page No.# 3/3 Sheet No. 76/2025, dated 17.04.2025, it is provided that the petitioner shall appear before the learned Court below and on his appearance and on his filing a petition for grant of regular bail, the learned Court below shall consider the same in accordance with law.
