Heard learned counsel for the petitioner, learned Standing Counsel for the State and Sri K.K. Chand, learned counsel appearing for respondent no.3. The petitioner has preferred the instant writ petition against a notice dated 04.08.2025 issued by respondent no.3. Learned counsel for the respondents submit that the writ petition is not maintainable as it is against the notice. It is a well settled law that the writ petition against a show cause notice is not maintainable. Reference may be made to the judgments of the Supreme Court in the case of Executive Engineer, Bihar State Housing Board v. Ramesh Kumar Singh and others, AIR 1996 SC 691; and State of U.P. vs. Brahm Datt Sharma and another AIR 1987 SC 943 etc.. In view of the above, the writ petition stands dismissed. After passing of the aforesaid order, learned counsel for the petitioner prays to withdraw this writ petition. Ordered accordingly.
