3. Pass such other or further writ(s), order(s), or direction(s) as this Hon'ble Court may deem fit and proper in the interest of justice.”
4. Learned counsel for the Petitioner submits that due to the intervention of COVID-19, the Petitioner has failed to comply with the defects as pointed out by the Authorised Officer, Bhubaneswar Development Authority. He further submits that the Petitioner has filed appeal. The order passed in the said appeal states that since the Petitioner’s building is not conforming to the norms of SRUC and non-compoundable as per the provisions enshrined under the Scheme, hence, the appeal was disallowed. 5. Learned counsel for the Petitioner further contends that if the Petitioner was not eligible to be considered under the said Scheme, there was no point in asking for removal of the defects by the Department. 6. In view of such facts and submission, this Court grants liberty to the Petitioner to remove the defects as pointed out vide Letter No.18638 dated 24.05.2022/Annexure-10 issued by the Authorised Officer, Bhubaneswar Development Authority within a period of one month from today and submit the detailed report regarding the removal of the defects. In such event, the Authority shall consider in accordance with law. Digitally Signed Signed by: LITARAM MURMU Designation: P.A.
