Prayer in this petition, filed under Section 483 read with Section 528 of BNSS, 2023, is for grant of interim bail to the petitioner in FIR No. 76 dated 21.03.2025, registered under Sections 21 and 27-A of the NDPS Act, 1985 at Police Station Parao, District Ambala. 2. The petitioner has been booked in this case for commission of aforementioned offences on the allegations that on 21.03.2025, co-accuysed Hira Chawla was apprehended and 01 kg. of heroin was recovered from him. He was interrogated and suffered disclosure statement to the effect that he had been supplying contraband to the present petitioner and was receiving money in lieu thereof. He also disclosed that on 19.03.2025, the petitioner had given a sum of Rs. 10 Lakhs in cash to him for bringing contraband from Delhi and it was the same contraband, which had been recovered from him. The petitioner was nominated as accused on the basis of this disclosure statement and was arrested on 23.03.2025. Investigation now stands completed. It is argued by learned counsel for the petitioner that his brother is suffering from pancreatic cancer which is at its last stage. The presence of the petitioner with his brother is required for providing emotional as well as physical support and to make arrangement for his medical care. The parents of the petitioner are old aged and are suffering from age related ailments and hence are unable to take care of his brother. It is, thus, urged that the petitioner may be released on interim bail in order to enable him to take care of his ailing brother as well as other family members. 4. Respondent-State has filed the status report. Along with the same, copy of the statement of Smt. Kamla, mother of the petitioner, has been annexed, which shows that the brother of the petitioner is being taken care by his parents and the petitioner, who had been living separately from them from quite some time, had nothing to do with his family. It is also shown to be recorded that the treatment of brother of the petitioner is going on. Copy of the statement of the Municipal Councillor concerned has also been annexed, as per which, the petitioner has been disinherited by his family since long and the care of his brother is being taken by the parents and sister of the petitioner. In view of this report, this Court finds no reason to allow the petition and grant concession of interim bail to the petitioner.
