ORDER:
This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-
“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents trying to interfere with the possession of the petitioner’s land by allotting house site pattas to his villagers in Sy.No.123/8 and 9 an extent of Ac.0.20 cents approximately 800 Sq. Yards situated in Madapam Village of Narasannapeta Mandal of Srikakulam in the subjected land without procedure established by law from his respective premises, as illegal, irregular, arbitrary, unjustified, unconstitutional and unsustainable and direct the respondents to forbear from taking any further steps in that regard and pass such other order.”
2. Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.
3. Learned counsel for the petitioner submits that the petitioner’s ancestors were in possession and enjoyment of the land admeasuring to an extent of nearly Ac.1.00 cents. After the death of petitioner’s grandfather and father, the respondents issued house site pattas in respect of the part of the subject land i.e, Ac.0.20 cents to the weaker section people. Without following due procedure, the respondents initiated the said action. Hence, the present Writ Petition.

4. Learned Government Pleader for the respondents submits that if the respondents intent to interfere with the petitioner’s subject property, they will follow due process of law.
5. Having regard to the submissions made by the learned counsel for the petitioner and the learned Government Pleader for the respondents and on perusal of the material placed on record, this Court is of the considered opinion the present Writ Petition can be
disposed of directing the respondents not to interfere with the petitioner’s subject property, without follow due process of law.
6. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel miscellaneous application, pending, if any, shall also stand closed.
