The petitioners have filed the present writ petition under Articles 226/227 of the Constitution of India with a prayer to issue a writ in the nature of Mandamus directing the respondents to release the arrears of pay anomaly along with interest w.e.f. 01.11.2011, as per the Punjab Govt. Letter dated 13.10.2014 (Annexure P-17) as anomaly already stands removed w.e.f. 06.10.2014, in accordance with the decision of this Hon’ble Court as rendered in CWP No.22038-2016 titled as ‘Munish Kumar and others Vs. State of Punjab and others’ (Annexure P-19). 2. Learned counsel for the petitioners contends that a similar controversy was already considered by this Court in CWP No.22038 of 2016 titled as ‘Munish Kumar and others Vs. State of Punjab and others’ (Annexure P-19) and the benefit has been allowed to similarly placed employees by the respondents. Consequently, the petitioners are also entitled to the relief claimed in the writ petition. Learned counsel further submits that the petitioners have already submitted a representation dated 25.08.2025 (Annexure P-20) on the HEMLATA 2025.09.11 22:39 I attest to the accuracy and integrity of this document CWP-26968-2025 -2- respondents, but no decision has been conveyed to them so far. At this stage, he shall be satisfied in case, appropriate directions are issued to respondents No.3 and 4 to decide the representation dated 25.08.2025 (Annexure P-20) in a time bound manner. 3. Notice of motion. 4. On the asking of the Court, Mr. Charanpreet Singh, AAG, Punjab, who is present in the Court, accepts notice on behalf of the respondents and has no serious objection to the limited prayer made by learned counsel for the petitioners. 5. I have heard learned counsel for the parties and perused the record carefully. 6. At this stage, respondents No.3 and 4 are directed to examine the representation dated 25.08.2025 (Annexure P-20) and to decide the same within a period of four months from the date of receipt of certified copy of this order, by passing a speaking and well reasoned order. Respondents No.3 and 4 shall take into consideration the relevant rules/instructions in the present case and shall also take into account the fact that the same relief have been allowed to several other similarly placed employees. 7. The present petition is disposed of, accordingly.
