CRIMINAL PETITION
ORDER NO: 2351/2025
1. The Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioners/accused Nos.2 & 3 to grant anticipatory bail in connection with Crime No.124 of 2024 of Nandyal I Town Police Station, Nandyal. 2. A case has been registered against the petitioners/accused Nos.2 & 3 and another for the offences punishable under sections 318 (4), 308 (5) read with 3 (5) BNS. 3. Case of the prosecution is that, the de-facto complainant, being the resident of Neeli Veedhi of Nandyal Town, used to visit Nandi Indoor Stadium situated at Bommalasatram of Nandyal town for playing Badminton, where, A1, being resident of Bommalasatram, was working as Badminton Coach, and that Al not only working in Nandi Stadium but also working in R.K.Stadium and Neravati Stadium as Coach. In the month of December 2023, Al expressed before the de-facto complainant that he is going to construct Indoor Stadium in Ac.0.50 cents in Balaji Complex for which, he is in need of money and asked the de-facto complainant to arrange money for construction of Stadium and offered partnership to the de-facto complainant in future. In view of the hal. 'J
2 acqual'ntance with A1,I,he transferred the amount of Rs.12.00 Iakhs I'n multiple transactions. Thereafter, since there I-s no information about the new stadl'um, the de-facto complainant got suspicion and demanded Al to return the money of Rs.12.00 lakhs for which, Al replied that he need further more amount of Rs.26.00 lakhs for construction of stadl-um and demanded the de-facto complainant to pay addI'tl'Onal amount of Rs.26,00 lakhs or otherwise, he would not return Rs.12.00 Iakhs and would not provide partnership in the stadium. Further Al threatened the de-facto complainant that he would kI'll him and his family members l'f he does not give the demanded amount. In the end of December, 2023, the de-facto complainant requested Al to return Rs.12.00 Iakhs. ln response, A1, along wI®th hl's wife and his younger brothers I-.e. the petl'tioners/A2 and A3, came to the house of the de-facto complal-nant and threatened him demanding to give Rs.26.00 Iakhs faI'lI-ng Which, they would kill the de-facto complainant and hI-S family members. out of fear, the de-facto complainant provI-ded the demanded amount of Rs.26.00 [akhs. Even after several days, the accused did not construct stadium.

5. A perusal of the materl'al available on record goes to show that the petitioners herein are the accused Nos.2 & 3. All the allegations are directed agaI'nSt the accused No.1. Pr,'ma fac,-e, there are nO accusations inSOfar aS the Petitioners concerned. Subsequently, at a belated stage, it has been added by the de-facto complainant that the petitioners threatened him to construct the Stadium. The said accusation is nothing but improvement in the F.I-R.
6. Since the allegations are directed only against the accused No.1, this Court is inclined to grant anticipatory baI'l tO the petitioners/accused Nos.2 & 3. 7. Accordingly, in the event of their arrest, petitioners/accused Nos.2 & 3 shall be released on bail on executI'ng a Personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) each, with two sureties for the like sum each to the satisfactI'On Of the arresting POliCe Officials and also on conditiori that the petitioners shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioners shall appear before the station House Officer concerned Once in a Week i.e. On every Sunday between 10.00 a.m. and 05.00 p.m., till filing of the charge sheet. 4
