Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioners have, inter alia, prayed for the following reliefs:-
“i) That writ of mandamus may kindly be issued, directing the respondent authorities to remove the encroachment of the private respondents from the land of Ministry of Road, Transport & Highways of India (MORTH)
and
also
demolish
the
illegal construction/structures constructed over the Government 1Whether reporters of the local papers may be allowed to see the judgment?
2 2025:HHC:7738 land in Kaffota Bazar, Tehsil Kamrau, District Sirmour, H.P. immediately, so that National Highway-707 from Paonta Sahib to Gumma can be constructed as per the plan and acquisition thereto. (ii) That writ of mandamus may kindly be issued, directing the respondent authorities to decide the representations dated 05.03.2025 & 11.03.2025 Annexure P-6) made by the petitioners within a time bound manner. (iii) That writ of mandamus may kindly be issued, directing the State authorities to remove the encroachment of the private respondents from the land of Jal Shakti Vibhag at Kaffota, Tehsil Kamrau, District Sirmour, H.P.”
2. Learned counsel for the petitioners submits that the petitioners do not have any personal interest in the cause but fact of the matter is that they are residents of that area and they are aggrieved by the fact that Authorities are not taking any action against the private respondents, who are carrying out construction by encroaching upon the Government land/already acquired land.
3. In the light of the fact that the petitioners are pro bono, who are raising a public cause, this writ petition, as
3 2025:HHC:7738 prayed for, is allowed to be withdrawn, with liberty to the petitioners to file a writ petition on the format of a Public Interest Litigation. Pending miscellaneous applications, if any, also stand disposed of.
