The petitioner has been made accused in connection with Gawan P.S. Case No. 84 of 2024 instituted under Sections 78, 96, 127 (2) of the BNS, 2023.
Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in procuration of the minor victim girl and outraged her modesty. It is submitted that the allegation against the petitioner is false. Learned counsel for the petitioner files the photocopy of Aadhar card of the alleged victim and submits that she is present in the Court today and as per the Aadhar card, she is a major lady as her date of birth is 20.10.2005. Keep the Aadhar Card in the record. Drawing attention of the court to Annexure 2 of the brief, which is the copy of the certified copy of the joint compromise petition, filed by the alleged victim and the petitioner in the court of learned Additional Sessions Judge, III, Giridih, it is further submitted by learned counsel for the petitioner that therein, it has been categorically mentioned that the petitioner and the alleged victim were in love and they have solemnized marriage out of their own will and only because, the informant has not approved the marriage of the petitioner with the victim, hence, this false case has
been instituted. It is next submitted that the petitioner has been in jail custody since 27.12.2024 , as mentioned in para 17 of this bail application. It is next submitted by learned counsel for the petitioner that the petitioner is ready and willing to co-operate with the trial of the case and undertakes not to annoy or disturb the informant or the other witness of the case in any manner during trial of the case, hence, the petitioner may be admitted on regular bail. Learned Addl. P.P. opposed the prayer for regular bail . Considering submissions of learned counsels and the facts as stated above, I am inclined to release the petitioner on bail. Hence, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs.
25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned JMFC, Giridih in connection with Gawan P.S. Case No. 84 of 2024 with the condition that the petitioner will not to annoy or disturb the informant or the other witness of the case in any manner during trial of the case and will co-operate with the trial of the case and will furnish mobile phone number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change the mobile phone number during the trial of the case.
