JUSTICE DEVASHIS BARUAH ORDER 17.02.2025 Heard Mr. H Buragohain, the learned counsel appearing on behalf of the appellant. Ms. K Phukan, the learned counsel appears on behalf of respondent Nos.13 and 14. None appears on behalf of the remaining respondents. 2. The instant appeal arises on account of not granting an ex-parte ad-interim injunction in favour of the appellant in Misc.(J) Case No.147/2020 arising out of Title Suit No.118/2020. It is relevant to take note of that the said injunction Page No.# 5/6 proceedings are still pending before the learned Trial Court and the defendants have duly appeared in the said suit. 3. It is also relevant to take note of that this Court had in the accompanying interlocutory application being IA(C)No.977/2020 vide an order dated 18.03.2020 directed both the parties to maintain status-quo in respect to the land covered under Dag No.3087 of Patta No.1555 and Dag No.3088 of Patta No. 1556 in village Borsojai under Mouza Beltola in the district of Kamrup(Metro). The said interim order thereafter had been continued from time to time. It is the opinion of this Court that it would not be in the interest of justice for allowing two parallel injunction proceedings, to continue inasmuch as, the injunction proceedings is still pending before the learned Trial Court. 4. Accordingly, the instant appeal stands disposed of with a direction to the learned Trial Court to dispose of the said injunction proceedings within a reasonable period and preferably within 30 days from the date of appearance of the parties before the learned Trial Court and till the disposal of the said injunction application, the order dated 18.03.2020 passed in IA(C)No.977/2020 be continued. Accordingly, the instant appeal stands disposed of with the following observation(s) and direction(s): (i). Mr. H. Buragohain, the learned counsel appearing on behalf of the appellants submitted that the next date fixed before the learned Trial Court is 03.03.2025. On the said date, the learning counsel appearing on behalf of the appellants shall place before the learned Trial Court the order passed today and the learned Trial Court shall on the basis of the direction so passed shall expeditiously dispose of the said injunction application and preferably within a period of 30 days from 03.03.2025. The interim order dated 18.03.2020 passed in IA(C)No.977/2020 shall continue till the Page No.# 6/6 disposal of the said injunction proceedings i.e. Misc.(J) Case No.147/2020. (ii). This Court further takes note of that the records of Misc.(J) Case No.147/2020 was called for. The Registry is directed to forthwith return the records to the Court of the learned Civil Judge (Senior Division) No.3 Kamrup(Metro) at Guwahati so that the said Court is in a position to take up the injunction proceedings on 03.03.2025 as directed hereinabove.
