Mr.Virender Singh Kanwar, Advocate, for the applicant/respondent. CMP No.8399 of 2025 This application has been filed for seeking direction to the Commissioner, Employees Compensation, Una for releasing the amount of compensation in favour of the applicant-respondent-Sunil Kumar, which has been deposited by the appellant-Company. Prayer for release of amount has been opposed by the learned counsel for the appellant on the ground that there is every likelihood of reduction of the amount of compensation at the time of final adjudication. Learned counsel for the appellant submits that applicant is agitating for getting just and fair compensation since long but he has not been received yet. Taking into consideration the rival contention of the parties, maintaining the balance of interest of parties, at this stage, 50% amount of compensation alongwith proportionate interest is directed to be released in favour of the applicant-respondent No.1-Sunil Kumar by remitting the same in his savings bank account on producing copy of this order alongwith details of the account before the Commissioner, Employees Compensation, Una. The aforesaid release shall be subject to final outcome of the appeal and in case, at the time of final adjudication of appeal, it is found that excess amount has been released to the applicant-respondent No.1-Sunil Kumar, he shall refund the excess amount alongwith reasonable interest thereon. The parties are permitted to produce copy of order downloaded from the High Court website and the concerned authorities shall not insist for certified copy of the order, however, they may verify the order from the High Court website or otherwise.
