This is an application filed by the petitioner praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, apprehending his arrest for offences under Sections 47(a),(e), (f) of Excise Act and Section 275 and 292 of the Bhartiya Nyaya Sanhita.
3. After hearing the learned counsel for the parties, I find that huge quantity of mahua liquor was illegally being manufactured. From 10 tubes each containing 30 liters of illegal mahua liquor, total 300 liters and 5000 kg Jawa Mahaua was recovered. During investigation, it was found that it was petitioner and another who are involved in brewing of illicit liquor.
4. The learned APP opposes the prayer for anticipatory bail.
5. Considering the said allegation and the materials recovered, I find that this is not a fit case for grant of anticipatory bail to the petitioner.
6. Accordingly, the prayer for anticipatory bail of the petitioner in connection with MGM P.s. Case No.179 of 2024, pending in the Court of learned Judicial Magistrate, 1st Class, Jamshedpur, stands rejected.
7. Petitioner should appear before the Court concerned, who will pass an appropriate order.
