Heard Mr. Jitendra Nath Upadhyay, learned counsel for the appellant and Mr. Manoj Kumar Mishra, learned counsel for the State.
This appeal is directed against the order dated 22.02.2025 passed by the learned Additional Sessions Judge-I, Seraikella in S.T. Case No.187 of 2024 and M.C.R.A. No.175 of 2025, arising out of Kharsawan P.S. Case No.31 of 2024, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that on an information five persons including the appellant were apprehended by the police and from the possession of the appellant, a country made pistol and two live cartridges were recovered. It has been submitted by the learned counsel for the appellant that the appellant is in custody since 24.06.2024 and one of the co-accused similarly situated has been granted bail by this Court in Criminal Appeal (D.B) No. 394 of
2025.
Regard being had to the above, we, while setting aside the order dated 22.02.2025 passed by the learned Additional Sessions Judge-I, Seraikella in S.T. Case No.187 of 2024 and M.C.R.A. No.175 of 2025, arising out of Kharsawan P.S. Case No.31 of 2024, direct that the appellant, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Seraikella, in connection with S.T. Case No.187 of 2024 and M.C.R.A. No.175 of 2025, arising out of Kharsawan P.S. Case No.31 of 2024. This appeal is allowed.
