Heard the parties.
The petitioner has been made accused in connection with Poraiyahat P.S. Case No. 128 of 2023, corresponding to G.R. No.1747 of 2023, S.T. No.62 of 2024, for the offence registered under Sections 304B/34 of the Indian Penal Code, pending in the court of learned Additional District & Sessions Judge-II, Godda.
Bail application of the petitioner was earlier rejected by this Court in B.A. No. 1660/2024, vide order dated 09.04.2024.
Petitioner is said to be the husband of the deceased who died due to burn injuries in her matrimonial home. There is allegation against him that he had tortured the deceased to enforce the demand of dowry.
It was submitted that charge has been framed in this case under Section 306 of the Indian Penal Code. It was further submitted that all the independent witnesses have turned hostile.
Learned Spl.P.P on behalf of the State has opposed the prayer for bail and submitted that the deceased had committed suicide because she could not bear the torture meted her to enforce the demand of dowry.
In view of the aforesaid fact, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected.
Learned Trial Court shall expedite the trial.
