No.92 of 2022(10) dt.21-08-2025 2/2 been filed against the order dated 24.01.2022 by which the amendment of Written Statement after evidence of both the parties has been rejected by the trial court vide order dated 24.01.2022. 2. Heard the parties. 3. The proposed amendment annexed as Annexure 1. From perusal of entire facts, defendant wants to plead a new facts regarding his case which is not permissible after much delay in the suit. 4. Regarding the aforesaid fact, he ought to have file a new cross suit against the plaintiff of the suit. 5. The aforesaid facts cannot be amended in his Written Statement because it amounts to delay in trial. 6. Accordingly, the prayer for proposed petition has got no merit and hence, stands dismissed.
