The petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking quashing of FIR no.53 dated 02.04.2025, registered under Sections 18(b), 29, 27, 61,85 of NDPS Act, 1985, at Police Station Sadar Shri Muktsar Sahib, District Shri Muktsar Sahib.

Learned counsel contends that it is a case of false implication because the petitioner has remained personal assistant to the Leader of the Opposition in the State, and it is on account of political rivalry that he has been nominated as an accused.

Learned State counsel, however, contends that investigation in the case is going on. And as per the disclosure by main accused, 3.208 grams of opium was purchased from the petitioner. PAYAL 2025.09.18 09:20 I attest to the accuracy and authenticity of this

Considering the facts aforementioned, this Court finds no ground to entertain the petition. Learned counsel for the petitioner has not been able to indicate that the offences alleged are not even prima facie made out against the petitioner as per the allegations. The submissions regarding false implication on account of political rivalry have also not been substantiated in any manner, and the same do not afford any ground to quash the FIR at this stage.
